TERMS AND CONDITION
1. Seller
1.1 The Seller is Motif Online Ltd, 378a Leeds Road, Flat 2, Bradford, United Kingdom, BD3 9QX.
2. Order Process
2.1 The display of products on our website constitutes an invitation to treat and not an offer to sell those products to you.
2.2 An offer is made when you place an order for products. However, no contract will be formed between us unless and until we accept your offer (see clause 2.5 below).
2.3 Payment will be taken from your card once we process your order and have verified your card details. Products are subject to availability. If we are unable to supply a product, we will inform you as soon as possible, and a full refund will be issued if you have already paid for it.
2.4 Provided you have entered a correct email address, we will send you an order acknowledgement email and any subsequent order update emails. These communications do not constitute confirmation or acceptance of your order.
2.5 Unless we have notified you that we do not accept your order, or you have cancelled it, order acceptance and the formation of the contract between you and us (or the relevant retailer in respect of certain sales facilitated by us) will take place when the products you have ordered are dispatched from our warehouse for delivery to the address you have provided. The contract does not come into effect before this point, even where your card has already been debited (see clause 2.3) or an acknowledgement email has been sent (see clause 2.4). On rare occasions, an error may occur resulting in a discrepancy between the products described on our website and those actually available for sale. Where this occurs, your order will not be accepted, or will be treated as not having been accepted. We may contact you to ask whether you would like to purchase an alternative product, or to keep a product that was dispatched in error, in which case your order will be amended accordingly. Otherwise, the order will be treated as cancelled, and any incorrect products dispatched will be collected and a full refund issued.
2.6 The contract will be formed at the place from which the products are dispatched.
2.7 All orders placed on this website are subject to acceptance in accordance with clause 2.5 of these terms and conditions.
2.8 We do not retain a record of your order for you to access. Please print and keep a copy of these terms and conditions and your order acknowledgement for your own records.
3. Payment
3.1 Payment may be made using any of the methods set out in our payment options. Where payment is made by gift card or credit note and the balance exceeds the value of your order, the order total will be deducted from the gift card and the remaining balance will stay on the card.
3.2 You will be charged the price displayed on our website at the date on which you place your order. All prices shown on our website are inclusive of VAT, where applicable. We reserve the right to amend prices in the event of a change to the rate of VAT. The total price shown at checkout represents the total amount payable by you for those items, regardless of the delivery address. For deliveries within the EU, this price includes VAT (or its equivalent) at the applicable rate. Although the price for deliveries outside the EU remains the same, even where VAT (or its equivalent) may not apply, customers are not entitled to any discount or refund to reflect the difference in tax treatment, and will pay the same price as a customer ordering for delivery within the EU. Other elements of the total price shown at checkout, such as delivery charges, may vary depending on the customer.
3.3 A delivery charge will be applied at checkout. Please refer to our delivery charges for further details.
3.4 We take care to ensure that prices are displayed correctly; however, errors may occasionally occur. Where this happens, we will correct the price and ask you to confirm whether you wish to proceed with the purchase at the corrected price. If we are unable to contact you, the order will be treated as cancelled. We reserve the right not to accept an order affected by a pricing error.
4. Delivery
4.1 A signature may generally be required to acknowledge delivery. The signature of the person accepting delivery at the delivery address will serve as proof that delivery has been received by you or by the person to whom the order was addressed. If no one is available to accept delivery, a card will be left to advise that delivery was attempted and that the product(s) have either been left with a neighbour or returned to our warehouse.
4.2 For Next Day Home deliveries, orders will only be delivered the next working day if placed before 1pm. Orders placed after 1pm will be processed but will not be delivered until the following working day thereafter. "Working day" means any day from Monday to Friday, excluding bank holidays.
4.3 It is your responsibility to ensure that the delivery address is ready to accept delivery of the product, including ensuring that there is adequate space for any delivery vehicle to complete the delivery.
4.4 For orders delivered to freight forwarding companies, hotels, bed and breakfasts, or storage and relocation companies nominated by you to accept delivery on your behalf, we accept no liability for any product that is damaged after acceptance of delivery by such locations. Such goods are held at your own risk from the point of delivery to these locations or carriers.
4.5 We accept no liability for any delay or failure to deliver a product arising from circumstances beyond our reasonable control, including, without limitation, delay or failure caused by adverse weather conditions, industrial action, or transport disruption.
4.6 In the unfortunate event that your parcel is lost or damaged by our delivery partners, please contact us so that we can investigate further. We will submit a claim on your behalf to the relevant delivery partner. Once the claim has been accepted, you will receive a full refund, including delivery costs. Please note that such claims can take up to 28 days to resolve, and an immediate refund cannot be issued. While our parcels are insured by our delivery partners, Motif Online Ltd, 378a Leeds Road, Flat 2, Bradford, United Kingdom, BD3 9QX, cannot be held responsible for parcels lost or damaged in transit.
5. Cancellation and Returns
You have the right to cancel any order you have placed. You may cancel an order at any point from the time of placing it up to fourteen (14) calendar days after the day following delivery of the product(s), in accordance with the Consumer Contracts Regulations 2013. To cancel, please return the item using one of our return options, in accordance with the following procedure:
5.1 You may contact our Online Customer Services Team by email or telephone, using the details provided on our Contact Us page. If you contact us to cancel your order before delivery, the order will be cancelled; however, delivery cannot normally be interrupted once dispatched, except where cancellation takes place within 30 minutes of the order being placed. In this case, please return the item(s) to us once received. Most products may be returned by post or arranged for collection through our Customer Services department. Until the item is returned, you must take reasonable care of it.
5.2 For instructions on how to return an order, please visit our Returns, Exchanges & Refunds page. A charge will apply for courier collections, in accordance with our returns procedure.
6. Clearance Sales
6.1 Any reductions shown reflect a reduction from the original price charged on the website.
7. General
7.1 All measurements provided are approximate.
7.2 The reproduction of colours is as accurate as photographic and production processes reasonably allow.
7.3 All risk in the products supplied to you, including the risk of loss or damage, passes to you upon delivery to the address specified in your order. Ownership of the products will not pass to you until payment has been received in full.
7.4 We shall not be liable for any indirect losses you may suffer, including loss of profit, income, or anticipated savings, arising from our failure to comply with these terms or from our negligence. This does not affect or limit our liability for death or personal injury caused by our negligence, which shall remain unrestricted.
7.5 These terms constitute the entire agreement between us in relation to the supply of products to you, and supersede all prior arrangements and representations, whether verbal or written.
7.6 We may amend these terms from time to time at our discretion, without prior notice. Any amendments will be published on this website and will supersede any previously published terms and conditions.
7.7 No delay or failure by us in exercising or enforcing any right or remedy under these terms shall constitute a waiver of that right.
7.8 If any provision of these terms is held by a court to be unenforceable, that provision shall be restated to reflect, as closely as possible, the original intent of the clause. If it cannot be so restated, it shall be deemed severable from these terms and shall not affect the validity of the remaining provisions.
7.9 You may not assign or sub-contract any of your rights or obligations under these terms without our prior written consent. No third party shall be entitled to enforce any of these terms, whether under the Contracts (Rights of Third Parties) Act 1999 or otherwise.
7.10 All matters relating to any offer or agreement for the purchase and sale of products through our website shall be conducted in English and shall be governed by and construed in accordance with English law. The English courts shall have exclusive jurisdiction over all such matters.
